A Ketchikan man is charged with a felony after allegedly assaulting his girlfriend with a Civil War-era rifle.
Brett Mackie faces the charge of assault in the third degree for causing fear of injury with a weapon, a class C felony.
According to court documents, Mackie and his live-in girlfriend were in an argument Sunday. He allegedly hit her and pressed a .33 caliber Winchester rifle against her throat. He then allegedly pointed the rifle at her, said it was loaded and threatened to kill her.
On Tuesday, Mackie’s attorney informed the court that the rifle used in the incident was an antique, non-functioning weapon given to the defendant as a gift.
Mackie was arrested and released on $10,000 bail over the weekend. He appeared in court Tuesday for a status hearing, where his bail was reduced and $5,000 was refunded to his father, who posted his bail.
Mackie’s next preliminary hearing is scheduled for Sept. 19.
